Sure they do. It may be the hosts job to ensure that the server isn't overloaded, however, that is subjective.

It's a client's responsibility to look for the obvious where over-selling is concerned. Ten Gb of storage and 1000 Gb of bandwidth for $10 a year is obvious overselling. Once a client is signed up with a host, if they notice that they have a 10 Gb account and using only 500Mb and the server storage is at 95% capacity, then there is obvious overselling. If the service is slow then it's time to move on.
