Yeah, that's true. They should be pretty evidential enough to prove it since after long 15 years.

The point is, if that happens it will impact on new comers,small business providers and lot of customers, which leads to a massive software changes in industry.

Even after 15 years they can still be brought to justice for copyright infringement and forced to stop using the software.
Only way round it would be to work a deal with the copyright owner

it boils down to who owns the thing you are doing.

i.e. You are told by your company to develop a piece of software. if you do this in the workplace or at home "in your own time" then the software belongs to your company as they instructed you to do this on their behalf.

These days with laptops, tablets and smartphone more and more developers are working away from their offices, so you need to make sure in any employment contract you are aware what the employer states about anything designed on their equipment in regards to copyright as even if you are at home and think of a piece of software that (lets say) can help your kids with their homework, so you create this on the company laptop, if the company has in your contract that anything designed on their equipment is copywritten to them, then they would own the copywrite to the software you have created.

Today, there are plenty of free-lance server admins and software developers who advocate on the pros of nginx and would have used it for multiple non-technical clients of theirs. Wonder how they would understand this stuff and get back to either their original freelancers or engage somebody new to handle either the transition to Apache or LiteSpeed!

Speaking of LiteSpeed this should help them increase there market share. Anyone who is fed up with Apache is starting to run out of alternatives.

Some quick updates on this

• Rambler fired "Lynwood Investments" the company that performed the initial investigation of the violation
• Rambler is dropping the criminal case
• Rambler plans to continue with civil case
• Rambler CEO (at the time of NGINX creation) said there was no such task in place creation and had no idea NGINX was being created

Seems like someone decided to do a money grab when F5 Networks acquired NGINX for the nearly $700 Million, and someone either at Lynwood or Rambler thought they could swoop in for a payday.

The whole thing has turned the development community against them.

This was obvious as how long has NGINX being going (4 October 2004; 15 years) and as soon as its acquired then this case appears.
Clearly the acquisition trigged someone or something.
