Yes.

If you have to ask the question, then yes, yes you should, without a doubt.

And even sometimes when you don't know to ask the question.

It's an investment, but it will ensure that you don't leave yourself open to ruination later on down the road.

Many things need to be worded correctly from the get go, because customers later on can file for compensation for damages caused by you not wording correctly originally, even if you change them to protect yourself later on.

For that matter, you aren't just protecting yourself, here, you are protecting your customer and all business relationships otherwise that you establish with your business.

If you do not have enough funds to invest in consulting a professional legally capable of advising you, then you don't have enough to invest yet to get started.

Ask yourself this:

If you don't have enough to invest in proper contracts and ToS wording, then why do you have enough to invest in getting a small business started only to see it fall under and cause you legal issues because you didn't do it correctly?

Dont hesitate..no one knows the law except the lawyer/s. No matter what you read on the internet - no matter what site offers the reason or answer to your question - there are loopholes in every lawsuit and only lawyers can guide you (else wouldnt microsoft be lawsuit free). each case has its own twist and turn - CONSULT A lawyer.

That depends too. Most lawyers will CHARGE, just to go over things with you. Unless you have a friend, who's a lawyer, be sure you have money to spend for advice. I'm sure there are free lawyer consultants at a lawyer forum.

Agreed...Always pick the one closest to the internet scene...laws on the internet and off the internet are very different.

The best time to spend with a lawyer is at the start of your business when you're preparing the documents (TOS, AUP, etc.) that govern it. Once you have a proper framework in place, things tend to proceed nicely.

There are so many hosting-related contracts available on the internet that you can typically spend time taking the best pieces from each and creating your own. Once you have done this, you should have it reviewed by council.

Well yea i think to take advise from a legal adviser is a better idea , but make sure that he a good in the field and have good knowledge on internet based stuff,,,..
